When that court refused to hear the case, the town voted to condemn Avalon’s property and take it by eminent domain. When the appellate court upheld the decision, the town knocked on the door of the state Supreme Court. When the Superior Court ruled in Avalon’s favor, the town appealed. Berman found himself in the uncomfortable position of suing the town in which he lived. The founder and president of Avalon Properties, Mr. WHEN Charles Berman first tried to develop affordable housing in this tightly zoned suburb, in the 1990s, town officials fought him for five years.
